The three agents of the Federal Highway Police (PRF) who are defendants for the death of Genivaldo de Jesus Santos will be submitted to a popular jury. The request, made by the Federal Public Ministry (MPF), was accepted by the Federal Court. Genivaldo, who was 38 years old, was killed after being approached by the police.
The crime took place in May last year in the city of Umbaúba, in Sergipe. On the occasion, he was approached during a PRF operation and placed in a car.
The victim was immobilized and placed in the trunk of the vehicle, when the police used pepper spray and tear gas for 11 minutes and 27 seconds, according to an expert report. The population recorded the moment when Genivaldo was inside the vehicle. He suffered from schizophrenia and had been treated for 18 years.
In the report on his death, it was found that the death was caused by mechanical asphyxia and inflammation of the airways.
The three police officers, Paulo Nascimento, William Noia and Kleber Freitas, are responsible for the crimes of torture and triple murder. The public prosecutors responsible for the case are also considering appealing for the agents to respond for the crime of abuse of authority.
A date for the trial has not yet been set.
Indemnity
On January 6, the Minister of Justice, Flávio Dino, announced that he had determined that steps should be taken so that Genivaldo’s family would receive compensation for the crime.
