General Sports Law is approved by the Federal Senate

The plenary of the Federal Senate approved, this Wednesday (8), in a symbolic vote, the PLS 68/2017, which creates the new General Law of Sport. The project’s rapporteur was Senator Leila Barros (PDT-DF). Now, the matter goes to the Chamber of Deputies.

The text, made up of just over 200 articles, provides, among others, about athletes’ labor rights, equality of awards between men and women, fair play, the fight against racism and xenophobia in stadiums and the typification of the crime of corruption. private in sport. It is also planned to include a representative of sports organizations of indigenous peoples in the National Sports Council (Conesp).

Senator Leila Barros understands that the PLS systematizes sport in the country. “The proposal consolidates the National Sports System, defining its composition and the attributions of each of the federative entities and entities of the sports segment, in a decentralized, democratic and participatory way, through which the management and promotion of public policies will be carried out. for the sport”, explained Leila.

The project also authorizes states to create fan courts, ordinary justice bodies with civil and criminal jurisdiction, to judge cases related to discrimination in sport.

One of the highlights of the proposal is the repeal of the Pelé Law, which deals with the relationship between players and clubs.

The Chamber of Deputies had already installed a special commission with the aim of modernizing the Law. Now, this commission must continue the work before the matter is taken to the Plenary.

The project also provides that Anesporte will be able to apply administrative sanctions to people, associations, clubs or companies that practice intolerance in sport. Fines range from minor infractions, R$500 to R$3,000; serious infractions, R$ 3 thousand to R$ 60 thousand; and very serious infractions, R$ 60 thousand to R$ 2 million.

Also according to the proposal, the Union will provide individuals or companies with the option of applying Income Tax installments to sports, as donations or sponsorships. The amounts will be limited to a maximum of 7% of the tax due for individuals, and 3% for companies.
