The Federal Court of Sergipe denied an appeal from the defense of three former federal highway police officers accused of killing Genivaldo de Jesus, in 2022, during a traffic stop.
At a hearing on Wednesday afternoon (19), the lawyers presented an embargo of nullity, which would have meant the ruling was null and void.
Pronouncement is when the judge, when deciding to pronounce the accused, admits the accusation made and forwards it for trial before the Jury Court. This occurs when he is convinced of the materiality of the fact (crime) and of sufficient evidence of authorship or participation. This stage has already passed.
The judge then denied this request for nullity and will schedule the trial, but there is no deadline.
Regarding the nullity, there is still an appeal. If the defense does not appeal, the jury date is set.
Genivaldo case
Genivaldo de Jesus was killed in May 2022 in the case that became known as the “gas chamber”.
This is because he died of asphyxiation after being placed in the prisoner compartment of a PRF vehicle, where agents used pepper spray and tear gas, according to a complaint from the Public Ministry.
The road agents were arrested and reported by the MP.
The police officers were also fired by the then Minister of Justice and Public Security Flávio Dino, in August last year. With that, they left the ranks of the corporation.
Before Dino, the PRF had internally decided to dismiss the police officers involved and sent the 13,000-page process to the Ministry of Justice, which was responsible for giving the last word in the case, accepting the dismissal.
When contacted, the defendants’ defense preferred not to comment.
