Genivaldo Case: MPF advocates increased PRF agents penalties

This Thursday (3), the Federal Public Prosecution Service (MPF) requested the Federal Regional Court of the 5th Region (TRF5) the increase in penalties of three former federal roads. The accused were sentenced in December 2024 for the death of Genivaldo Santos de Jesus during a PRF approach in the city of Umbaúba in Sergipe in May 2022.

The court had already increased the initial sentence in January 2025. William Noia and Kleber Freitas, convicted of torture with death results, had their 22 -year -olds, 2 months and 25 days to 23 years, 8 months and 14 days. As for Paulo Rodolpho, convicted of the Judgment Council for Dolosa Homicide, was denied the request for recognition of his conduct as a manslaughter.

In the appeal, the MPF requires that Paulo Rodolpho Nascimento’s sentence is increased to 30 years of imprisonment. For William Noia and Kleber Freitas, the request is to make your penalties raised to 25 years and 13 days in prison.

The Federal Public Prosecution Service emphasizes the severity of the case, highlights the brutality of the crime and the contempt for human dignity, committed by public agents who had a legal duty to protect Genivaldo Santos. It is also emphasized the vulnerability of the victim, who was a mentally disabled person and offered no risk to police during the approach.

Prosecutors who sign the appeal stress that the crime shook the confidence of society in public security institutions and caused damage to the image of the Federal Highway Police. The case of Genivaldo Santos exposes Brazil to the risk of being held responsible by the Inter -American Court of Human Rights (IACHR).

“The adequacy of penalties to international standards is not only a matter of justice in the present case, but a necessary measure to avoid new convictions of the Brazilian State and, especially, to prevent the repetition of similar violations,” the prosecutors highlight.

Genivaldo Santos died shortly after being approached by the Federal Highway Police team. Death occurred by asphyxiation, as reported by the prosecutor. It was placed in the prisoners of the PRF car, where agents launched pepper spray and tear gas. The 7th Federal Court of Sergipe determined that the Union pay an indemnity of R $ 1 million for moral damages to the victim’s son. In the same trial, it was agreed that Genivaldo’s mother would receive $ 405,000. Of the total, R $ 400 thousand refer to compensation for moral damage and the other R $ 5,000 correspond to the amount of the burial.
