Palestinian Authority President Mahmoud Abbas enjoyed diplomatic immunity during his recent visit to Berlin, according to the German Foreign Ministry, ahead of a police investigation into the Palestinian leader “for inciting hatred” after his statements about “50 holocausts by Israel at the expense of Palestinians”.
“In the assessment of the Ministry of Foreign Affairs, Mahmoud Abbas, for his visit to Berlin – as it was an official visit in his capacity as a representative of the Palestinian Authority – is subject to the immunity provided by international law, even if Germany does not currently recognize a Palestinian state,” ministry spokesman Christopher Burger said recently.
Mr. Burger clarified, however, that regarding the rules of the procedure initiated by the police, “it is the competence of the judicial authorities to examine whether in this particular case the conditions of immunity, as described in the Constitution, are met.” According to our own assessment, however, “Mr. Abbas enjoys a status of immunity”, the representative emphasized.
