Gilmar gives a deadline for AGU to express its opinion on the implementation of the National Environmental Education Policy

Minister Gilmar Mendes, of the Federal Supreme Court, sent to the plenary of the Court an action asking for the implementation of the National Environmental Education Policy (PNEA) after decrees that revoked the structure focused on the subject in the Ministries of Education and the Environment. The minister also asked the Attorney General’s Office and the Attorney General’s Office for information.

“Considering the relevance of the matter under analysis, I adopt the rite of art. 12 of Law no. 9,868/99 and I determine: 1) definitive information is requested; 2) then, the case file is forwarded, successively, to the Advocate General of the Union and to the Attorney General of the Republic, so that they manifest themselves within a period of 5 days. Publish yourself”, said the minister.

The action was presented by the Workers’ Party (PT), which alleges the “destructuring and dismantling” of the bodies and policies aimed at implementing the policy.

The PNEA was established by Law 9,795/1999. According to the legend, the changes promoted by decrees prevented the applicability of the policy. In one of them, the acronym indicates that there is no longer any body dealing with the subject. In another, the Department of Environmental Education and Citizenship was created, subordinated to the Secretariat of Biodiversity, but with significantly reduced attributions.

Another example cited is that the last meeting of the Advisory Committee of the PNEA Management Body took place in December 2018. The PT also points out that, in 2018, the then Department of Environmental Education carried out, with its own resources and that of partners, more than R $6 million. In 2021, the budget of the Department of Education and Environmental Citizenship was R$ 180 thousand and, even so, it was not fully executed.

In the caption’s evaluation, the Executive’s acts contradict several fundamental precepts of the Federal Constitution, such as the guarantee of social development and the social right to education and the environment, especially in relation to the promotion of environmental education at all levels of education and the public awareness for the preservation of the environment.
