Minister Gilmar Mendes, of the Federal Supreme Court (STF), voted this Friday (15) in favor of the release of former player Robson de Souza, known as Robinho.
The former athlete has been in prison since March 22, serving a 9-year prison sentence for a gang rape committed in Italy in 2013. The Italian sentence was confirmed by the Brazilian court.
Gilmar voted to suspend the process of ratifying Italy’s decision, carried out by the Superior Court of Justice (STJ). The consequence would be Robinho’s release.
In his vote, Gilmar argues that the process has not yet exhausted all possibilities for appeal in Brazil.
The score is now 2-1 to keep the prison. The rapporteur, Luiz Fux, and Edson Fachin voted to reject Robinho’s defense request.
The STF analyzes two habeas corpus presented by Robinho’s defense. The trial resumed in a virtual session that began this Friday (15) and runs until November 26.
In the format, there is no debate between the ministers, who present their votes in an electronic system.
