Government sanctions law authorizing telemedicine in Brazil; see rules of practice

The law regulating the practice of telemedicine in Brazil was sanctioned by the President Jair Bolsonaro (PL) on Tuesday (27). THE legislation establishes the criteria for remote medical care, which gained space in the country with the Covid-19 pandemic.

Also called telehealth, the modality consists of offering health services through the use of communication technologies involving the secure transmission of data and information.

“Telehealth covers the remote provision of services related to all professions in the health area regulated by Organs competent bodies of the federal Executive Branch”, says an excerpt from the law.

Among the rules established by the legislation are the autonomy of the health professional, the patient’s right to refuse care in the distance modality and data confidentiality. See below:

  • autonomy of the health professional;
  • free and informed consent of the patient;
  • right to refuse telehealth care, with the guarantee of face-to-face care whenever requested;
  • dignity and appreciation of the health professional;
  • safe and quality patient care;
  • data confidentiality;
  • promotion of universal access for Brazilians to health actions and services;
  • strict observance of the legal attributions of each profession,
  • digital responsibility.

According to the sanctioned law, the acts of the health professional, when practiced in the telehealth modality, will be valid throughout the national territory.

Furthermore, it is incumbent upon the federal inspection councils for professional practice to regulate ethics regarding the provision of services, applying the normative standards adopted for face-to-face assistance modalities.

According to the norm, it is mandatory to register medical services intermediary companies, thus considered legal entities that hire, directly or indirectly, medical professionals for the exercise of telemedicine, as well as the registration of a medical technical director of these companies, at the Regional Council of Medicine of the states where they are headquartered.
