The circular from the Ministry of the Interior has arrived on the controls related to the Green pass. After consultations with the Ministry of Health, but also following the opinion of the Privacy Guarantor, the document with the guidelines arrived. The managers of public places are obliged to ask customers for the green pass, but not the identity document. However, they can do so in the event of a clear violation. The random checks of the police remain.
CHECKS
So here’s what restaurant managers and other public places have to do.
They must verify that the customer has the green certification at the entrance. Only in case of doubt, that is, if the data does not seem to coincide with the person who presented the document. The circular states that the request for identification is “necessary when the manifest inconsistency with the personal data contained in the certification itself appears”.
This is what the Privacy Guarantor had already said when answering a question from the Piedmont Region. The Authority speaks of possibilities without obligation. “The figures authorized to verify personal identity are indicated in article 13 of the Dpcm of 17 June 2021 and therefore also the owners of accommodation facilities and public businesses”.
The check is done with thefree app CheckC19 installed on a mobile device for which an internet connection is not required. The app does not store any personal information on the device.

If there is a customer without a Green Pass in the restaurant, the fine is for him and for the manager. If, on the other hand, there is a mismatch between the certificate and the person who shows it, the penalty is only for the customer “where there are no obvious responsibilities on the part of the operator”.
Anyone found in a public place without a Green Pass risks a fine of between 400 and 1000 euros. There is complaint for forgery if the certificate does not match the document. If the manager lets someone in without a green pass, he risks a fine and closure from 1 to 10 days.
GREEN PASS
The Green pass is obtained 15 days after the first dose of vaccine and is valid for 9 months. The alternatives are to be cured of Covid for no more than six months or to have one swab negative in the previous 48 hours. The certificate is announced by a text message or an e-mail. Anyone who has not received it can recover it.
In addition to indoor catering business, from 6 August, the Green pass is used for shows open to the public, sporting events and competitions, museums and exhibitions, swimming pools, indoor gyms and wellness centers, festivals and fairs, conferences and congresses, spas, theme and amusement parks, gaming rooms, betting rooms, bingo halls and casinos, cultural centers, social and recreational centers, excluding childcare and summer education centers.
To control must be the managers with the rules indicated above. In the museums it was already possible to ask for a document to verify the age of the person, in the case of a discounted ticket. For major events and stadiums «the so-called steward, that is the personnel enrolled in the appropriate lists of the Quaestors, whose employment in auxiliary services of the police forces is foreseen in the sports facilities ».
From 1 September the green pass obligation is extended to all staff of the school, to that of universities and university students. Always from the same date and until 31 December it will be required for planes, ships, ferries and long-distance buses. There is no requirement for urban public transport. To board ships and planes it is already necessary to present a document. It will also be required for trains.
