Guedes and Rosa Weber set up a meeting to discuss ICMS ceiling on fuels

The Minister of Economy, Paulo Guedes, has an appointment with Minister Rosa Weber, acting president of the Federal Supreme Court, this Thursday (7).

On the agenda is a lawsuit filed by governors against the ceiling on ICMS tax rates on fuel.

The meeting, which appears on the official agenda of Minister Guedes, will be at the STF and is scheduled for 5:30 pm. The agenda for the meeting was released by the Ministry of Economy.

The action questions Federal Complementary Law 194/2022, enacted in June, which classifies fuels, natural gas, electricity, communications and collective transport as essential goods and services, which prevents the establishment of rates above those established for operations in general. .

On July 1, Minister Rosa Weber decided to take the action directly to the plenary, without a preliminary injunction.

The process, however, does not yet have a date to take place. In the document, Minister Rosa Weber gave 10 days for the government to provide information about the law. The Chamber of Deputies and the Senate must also manifest.

According to the governors of Pernambuco, Maranhão, Paraíba, Piauí, Bahia, Mato Grosso do Sul, Rio Grande do Sul, Sergipe, Rio Grande do Norte, Alagoas, Ceará and Distrito Federal, authors of the request, this legal innovation imposes an excessive burden and disproportionate to the federated entities, compromising the continuity of essential services provided to the population.

The law challenged in the lawsuit establishes a limit of 17% to 18% for ICMS rates, depending on the federation unit. The states, which usually practice around 25%, estimate a billion-dollar loss in revenue.
