Guidelines for the Register of Trade Unions of Employees and Employers’ Organizations

With a circular signed today by the General Secretary of Labor Relations of the Ministry of Labor and Social Affairs, Anna Stratinaki, clarifications and instructions are provided to the directly interested parties (employees’ trade unions and employers’ organizations) regarding the operation of the electronic application of the Register of Trade Unions of Employees and of Employers’ Organizations (GE.MI.S.O.E. – GE.MI.O.E.) in P.S. ERGANI.

For the registration in GEMISOE, the trade unions are distinguished:

· For those that are established after 1-1-2022 and must digitally register all the necessary documents stipulated by law in GEMISOE (original articles of association, order for registration in the appropriate books, proof of service of order, publication of summaries of articles of association, memorandum of association and table members of a temporary governing committee) and then they acquire legal personality and

· The existing ones, where the official copies are required respectively from the Court of First Instance with attention to the correct entry of the name and the registration numbers in the books of the Court of First Instance.

It should be noted that according to par. 6 of no. 2 of Law 1264/1982, as applicable, non-registration affects the range of rights of trade unions. In order to complete the registration, all the documents/data mentioned in the circular must be registered.

The information must also be updated in a timely and immediate manner, i.e. any modification, changes in the management of the associations and any information related to the elections (number of those entitled to vote, number of voters, etc.). The registration of the data concerning the antiquities must be confirmed by the appointed legal representative.

Correspondingly, the employer organizations, for their registration in GEMIOE, must present their statutes validated by the Court of First Instance and the relevant data obtained from the book of associations kept in the relevant Court of First Instance. The employers’ organizations must provide the information of their members (and the legal entities they may represent), in order to facilitate the control of the conditions in the event that there is a request to declare a collective labor agreement as generally mandatory.

In order to maintain the data in GEMISOE and GEMIOE, the legislation on the protection of personal data is strictly observed. Data can be granted to the limited persons defined by the law only if there is a special legal interest. The relevant application for granting data is submitted electronically.

The online registration platform, accessible at https://mitroaorganoseon.yeka.gov.gr/ it is already being developed according to the content of the circular and within September it will fully support all the new features (modifying registrations and issuance of standardized certificates).
