Nassau County Judge Patricia Harrington has ruled that Christopher Ellis’s sentence should be lifted. He was convicted by jurors in 1992 of killing a man with only the testimony of an eyewitness.
“No evidence from the marking, no physical evidence,” the judge commented. Which found many more irregularities, such as the fact that the Long Island prosecutor’s office had concealed a number of important facts from the suspect’s defense.
Christopher Ellis was charged with the murder of 25-year-old assistant coach Harry Joseph Healy on September 29, 1990. Harrington found a number of smelly evidence mistrial, however, said Ellis could be tried again for the murder. It now remains to be seen whether the prosecution will pursue it.
The family of the 51-year-old celebrated like crazy the decision that took him out of prison. “I can not imagine the celebration that will be set up tonight and the wonderful dinner that I am sure everyone will have prepared for you,” the judge commented.
Outside the court, his family was waiting for him. “I am happy to be with my family, to enjoy life,” he told reporters.
The first thing he would do, he told them, was a stop for his favorite ice cream. “I knew that day would come, I just did not think it would be so late”…
