He was acquitted of sexually assaulting his 9-year-old daughter because he suffers from dementia

Father and former school principal acquitted of sexually assaulting his 9-year-old daughter while suffering from sepsypnia and was asleep when he touched her inappropriately.

The Australian told the court that he was surprised to see the police arrest him in November 2019. Police were informed that his daughter had accused him of abuse.

How he was acquitted of sexually assaulting his 9-year-old daughter

He never doubted that the little one was telling the truth, only he did not remember touching her sexually the two times they slept in the same bed.

And he was telling the truth. The New South Wales court acquitted him when the experts who examined him testified that he was suffering from insomnia (sexsomnia), a disorder that causes a person to engage in sexual acts while sleeping.

The term belongs to a Canadian professor and has been recognized psychiatrically since 2003. The prosecution accepted this, what the father did was not intentional. And he could have no control over his actions.

The little one went one day to her mom, who had just divorced her husband, and told her that something “horrible” had happened to her from her father. The girl had gone to sleep with him because she was startled by a noise and suddenly felt Dad’s hand in a place where it should not be.

She shouted “no!” He moved his hand to another point, muttering something. Soon, however, he took out his hand and began to snore. This happened twice in a few months.

The mother finally revealed that she had also sexually touched her sometimes in his sleep, when he was still a couple, without having any memories the next day. Even his former comrades testified at the trial that this had happened to them as well.

The psychiatrists who examined him confirmed that he was not pretending the symptoms. Judge Richard Weinstein ruled that the father had no pedophile tendencies.
