The Justice of Rio de Janeiro granted, this Tuesday (5), house arrest to teacher Monique Medeiros, mother of 4-year-old boy Henry Borel. The decision was made by Judge Elizabeth Machado Louro, from the 2nd Criminal Court of the Capital, and was based on Monique’s defense request.
Among the justifications, the magistrate cites the reports of prison violence suffered by the defendant. In testimony on February 9, Henry’s mother reported that she was threatened within the jail and that she was intimidated by inmates, a prison guard and lawyers before and after her arrest.
Despite the report of intimidation, the judge stressed in the decision that there was no proof of the allegations.
“It so happens that, even in a prison environment, the news of threats and violation of the applicant’s peace multiplied, which, despite not having been proven, gained the forum of public discussions in the press and social media, intensifying, even more , the hate campaigns directed against it” says the document.
The judge’s determination is that Monique be monitored through the use of an electronic anklet and not maintain any type of communication with third parties, that is, the defendant is prohibited from using the internet and cell phone.
According to the defense, the release permit should be issued on Wednesday (6), after the completion of bureaucratic processes.
“Justice has been done, it is necessary for us to differentiate Monique’s accusation from the circumstances of the process. She is responsible for the omission, unlike Jairinho who is responsible for the action. She has already been interrogated. Jairinho was not interrogated because he asked for the production of evidence. For this reason, the judge took this fact into account and said that there was no reason for her to remain in preventive detention and decreed other measures, basically house arrest and the placement of the ankle bracelet “, said the lawyer of Henry’s mother, Hugo Novais.
About Dr. Jairinho, the judge kept the former councilor in preventive detention. In the justification, it was considered that “there is no new element” that qualifies the modification of the current situation.
Arrested since April 2021, Monique and Jairinho were denounced by the Public Prosecutor’s Office for the practice of qualified homicide (for a clumsy reason, with an appeal that made it difficult to defend the victim and inflicted intense suffering, in addition to having been practiced against a minor under 14 years of age), torture , witness coercion, procedural fraud and misrepresentation.
The boy Henry died on March 8, 2021, after he suffered torture in the apartment where the couple and the child lived in Barra da Tijuca, west of Rio.
