Are you planning to hit the road this holiday? So, if you are going to drive, know that it is possible to drive the vehicle with only the digital version of the National Driver’s License (CNH), a document issued by the State Department of Transit (Detran) and mandatory for any driver in Brazil.
According to an ordinance published in 2017 by the National Traffic Department (Denatran), the CNH Digital has the same validity as the printed license. The agency emphasizes that obtaining this version of the document is the choice of each driver.
“CNH Digital is a version [eletrônica] of the National Driver’s License, with the same legal value as the printed one and obtaining it is optional. With all the information on the printed license, the document can be obtained through the CDT – National Transit Card application from SERPRO [empresa de tecnologia da informação do governo federal]”.
With this, the department reiterates that it is possible to use only the digital format of the CNH while driving.
How to proceed when stopped in a blitz
The lawyer specializing in civil law and partner at Advocacia Maciel, Alexandre Matias, explains that CNH Digital is regulated by Denatran Ordinance No. “reason why no public agent can refuse to accept its use”, which is valid throughout the national territory.
“If the traffic agent, even so, refuses to accept the document in digital format and draws up a notice of infraction, the driver can present a prior defense to the Detran and the public agent can eventually respond administratively for the act performed”, says the lawyer. .
The Detran-SP warns that the printed version of the CNH must have a QR Code (bar code). “CNHs issued from May 2017 already have this security item. If your CNH does not have the QR Code, request a 2nd copy of the document”.
Matias pointed out that all the information contained in the conventional CNH is in the digital CNH, such as photo, registration number, RG, CPF, affiliation, full name and date of birth, expiration date, license category and date of the 1st license.
“The visualization of the CNH Digital also works offline and can be done in places without an internet connection, and can be saved on the driver’s cell phone”, concluded the lawyer.
