How the digital work card will work – When it starts

of Dimitris Katsaganis

The digital work card will be implemented in June 2022 in banks, insurance companies, supermarkets and possibly in industries.

That became clear yesterday presentation of the new application myergani.gov.gr, the digital work card and the “Tool II” system by the Minister of Labor, Mr. Kostis Hatzidakis

The plan of the digital transformation of the labor market

As Mr. Hatzidakis noted, “at the Ministry of Labor and Social Affairs we are implementing a holistic plan for the digital transformation of the labor market with the aim of effectively tackling” black “and undeclared work.” This plan includes three basic tools that empower the employee:

First, the new application myergani.gov.gr, which enables employees to have direct access to the data declared for employment by employers / companies in the Information System ERGANI.

Second, the implementation of the digital work card, which is progressing. In the previous days, all stages of the tender were completed and the contractor starts work immediately, with the aim of starting the utilization of this tool in certain sectors in the coming months. The digital card will record the employment of employees (real time, overtime, etc.) in real time, which is a guarantee for the observance of the schedule. This is a real revolution that will prevent delinquency in the labor market, while imposing a level playing field between companies.

Third, the evolution of the P.S. INSTRUMENTS in PS INSTRUMENTS II with the aim of simplifying procedures and declarations, the holistic treatment of labor and insurance issues and the reduction of the administrative burden of companies.

Referring to the new service myergani.gov.gr, the Minister of Labor and Social Affairs stressed that “it provides employees for the first time with direct, quick and easy access to the data declared by their employer. Thus giving the employee an important control tool against” black “and suggested work”. From February 2022, myergani will be available in mobile app.

“The digital work card is one of the most important reforms included in the new labor law (4808/2021). It is a pioneering project at European level. Utilizing the latest technologies, empowers employees, ensures that everyone plays by the same rules “And it really helps to tackle undeclared work, which is probably the biggest problem with work today,” he added.

The digital work card is one of the first major projects of the Recovery Fund that is at such an advanced stage of implementation.

“It will start with large companies that already use timekeeping systems for employees, usually electronically, and will expand rapidly throughout the market. We will start with banks and supermarkets, but we will move on to all businesses large and small. “Employees in small companies can not have less protection than those who work in large companies,” said Mr. Hatzidakis.

“The digital transformation is proceeding with the upgrade and transformation of PS ERGANI into ERGANI II. The implementation of the project is already in progress since last June and is expected to be completed within the first half of 2022,” said the Minister of Labor and Social Affairs. He continued: “With the transition to ERGANI II, we seek, among other things, to reduce the administrative burden for companies, to simplify procedures by eliminating multiple declarations, the digitization of procedures that are still handwritten, etc.”.

At the same time, as Mr. Hatzidakis pointed out, “the digital transformation of the labor market is obviously directly linked to another reform included in the new labor law (4808/2021) with the upgraded and independent Labor Inspectorate. Especially the implementation of the digital work card and The online information of PS ERGANI about the working time is an important tool for immediate, effective audits. The auditors of the Labor Inspectorate before the audit in each company will have a complete and detailed list of employees who must be at the facility, as well as and the relevant statements made by his employer, for example, if an employer asks the employee not to “knock” the card at the time of starting work or to state that he has finished while staying at work “The control will be immediate, objective and strict.”

For her part, the Secretary General of Labor, Anna Stratinaki, who coordinates these actions, noted: “First of all, I would like to thank all those who worked for myErgani, officials and staff of the ERGANI system. The main concern of our efforts at the Ministry of Labor is digital transformation of labor market monitoring and the protection of workers’ rights to both health and safety as well as compliance with labor rules as defined by our labor law.

Stages

The digital transformation of the labor market is transformed into three stages:

1. Direct connection to the employee’s myErgani, which in addition to the employee will also be seen by the Labor Inspectorate.

The employee will monitor all the data of his work and will be able to intervene where he sees that there is data that does not agree with his work.

2. The evolution of INSTRUMENT I to INSTRUMENT II.

It is a very difficult process with the main axes being the simplification of procedures and the reduction of bureaucracy, the fast rendering of information in a more transparent way. There will be better data and, at the same time, data from forms of employment that until now did not appear since ERGANI I had in its axis the dependent paid work. These will be monitored and dealt with through the Labor Inspectorate. The evolution of ERGANI will be a working taxisnet. The work card will also be based on ERGANI II.

3. The automation of the Detailed Periodic Statement through ERGANI II.

This will put an end to the differentiation that exists in many cases between insurance and what is declared in the field of work. There will be a common, objective, transparent and directly observable source by the employee, which will give results for the working and insurance life of the employee.

For the first time, there will be an absolute connectivity of Law 4808/2021 with the entire regulatory framework that was completed immediately and the start of implementation within the framework of the law.

How myergani.gov.gr works

The search for information on myergani.gov.gr by the employee is done through 3 basic options:

With the option “My Employers” he can have access to all employment relationships with the employers he has employed (if they have been declared to PS ERGANI). He can also see the latest recorded data of each employment relationship, as they have been registered in the PS. INSTRUMENTS from the statements of the obligated employers.

With the option “Statements” he can search for all the statements (forms) that have been submitted to the PS. INSTRUMENTS by its employers, classified in the following categories:

– Start / End of Employment

– Changes in Employment (overtime, overtime, telework)

– Empty

– Special Employment Schemes

– COVID-19 measures

– Other

With the option “Covid-19 Payments” he has access to all the payments he has received from the Ministry of Labor and Social Affairs under the COVID-19 measures.

The digital work card

The implementation of the digital card will start with large companies that already use timekeeping systems for employees, usually electronically, and will quickly expand throughout the market.

The system will be implemented as follows:

a) Within the first quarter of 2022, the electronic “brain” of the work card will be ready, ie the electronic system, which will receive the information that will be digitally entered by both employees and employers. At the same time, a series of bureaucratic procedures are abolished in order to facilitate employees and companies.

b) Within the first half of 2022, the implementation of the Digital Work Card will begin with the monitoring of real employment in specific sectors of the economy, such as banks and supermarkets. The other companies, bigger and smaller, will follow quickly.

The digital card will not necessarily be a physical card like those already available today to many companies that implement working time timing systems. It can be a mobile application and a program on the business computers, both interconnected with the ERGANI. Of course the timing systems where they exist will be maintained and interconnected with the new system, in order to operate digitally.

It is also noted that:

– The system will have a display of all legal overtime limits, daily rest time, etc. as provided by law to create security for employees and employers.

– The system will have “cutters” to prevent irregular statements.

– There will be provisions at the technical level for all the special conditions recorded during the consultation, such as indicative work performed outside the company headquarters, business trips, emergency absence of the employee for personal reasons, etc.

From Ergani to Ergani II

The digital transformation of the monitoring system includes the upgrade and evolution of the PS. INSTRUMENTS IN INSTRUMENTS II.

The implementation of the project is already in progress since last June and is expected to be completed within the first half of 2022.

The main items that will be covered by this action are the following:

– Change of design philosophy in the procedures of submission of data by the companies with orientation to the required functions (process oriented) and not based on the forms that are already used

-Improvement / Expansion of the Submission Mechanism

Study for the availability of DPA preparation data

– Widening the Scope for the more complete mapping of Employment in the Labor Market

Creation of a Toolbox for Employers and Employees

– Creating an Open Data Interface

– Alignment with Gov.gr
