The circular of the Minister of Labor, Mr. Kostis Hatzidakis, clarifies the “status” of the operation of the platform for the acceleration of the award of pensions.
In detail, the circular provides that:
1. Creating a platform to accelerate the award of pensions
The Electronic National Social Security Agency (e-Ε.Φ.Κ.Α.) creates a special platform accessible through the Single Digital Portal of Public Administration (gov.grΨΨΠ), for the assignment by the interested insured or licensed professionals to the professionals of the partnership project in the process of granting pension benefits by e-EFKA and for the provision of services for accelerating the granting of pension benefits.
2. Access to the platform
Users of the special platform are:
(a) the insured persons or licensees concerned;
b) natural persons registered in the register of certified professionals
c) the competent employees of e-EFKA.
The access of the users with the use of the codes-credentials of the General Secretariat of Information Systems of Public Administration (GGPSDD) of the Ministry of Digital Government (taxisnet).
The access to the platform is made either directly to the electronic address “https://apps.efka.gov.gr/bAccess/” or through a relevant electronic link accessible through the Unified Digital Portal of Public Administration (gov.gr-EIP).
3. Project assignment process to certified professionals
The insured or licensee concerned during the process of submitting the retirement application chooses the possibility of routing his application to a certified professional of the relevant register.
Prior to the submission of the request for the use of the contracting service of the above project and for the purpose of judging the request, the above users are informed about the terms of processing of personal data by the administrators of the platform,
4. Specialization of operating elements and services of the platform
The platform defines special roles of administrators by the competent services of eEFKA depending on their responsibilities. Managers are responsible for configuring and customizing the platform according to the service and business needs that may arise during its productive operation.
After the assignment of the project, the certified professional can access through the above platform the supporting and other data of the contracting insured or licensee that are kept in information systems of e-EFKA and other public sector bodies, (Citizens’ Register, tax register of AADE etc) and which are required for the determination of the insurance period of the insured or licensee, the calculation of the amount of insurance contributions due, for the recognition of fictitious insurance period and the preparation of the relevant certificates and draft decisions.
The above access provides the ability to manage the display data of insurance time and insurance debts. The required interfaces of the platform with other information systems are made through the Interoperability Center (KED) of the General Secretariat of Information Systems of Public Administration (GGPSDD) of the Ministry of Digital Government.
In addition, the platform can provide the following opportunities to speed up the granting of retirement benefits:
(a) monitoring the progress of the project entrusted to a certified professional;
b) the submission of an application for recognition of fictitious insurance periods,
c) the appointment management of certified professionals;
(d) the registration of certificates and draft decisions drawn up by the certified professional;
e) the maintenance and updating of the register of certified professionals;
f) the possibility of training in the use of applications and computer systems of professionals after the completion of their theoretical training and before their certification;
h) protocol work for the competent services of e-EFKA.
5. Processing of data and applications
The issuance of the deed of granting the pension benefit and any other administrative act required for the award, is carried out by the employees of e-Ε.Φ.Κ.Α. through its information system.
The competent employees of e-Ε.Φ.Κ.Α retrieve the certificates and draft decisions that have been drafted and signed by the certified professional through the above
platform, which is interconnected with the information system of e-Ε.Φ.Κ.Α., in order to enable the issuance of the deed of granting the pension benefit and any other administrative act that is required.
The competent employees of e-Ε.Φ.Κ.Α. can verify the accuracy of the details of certificates and draft decisions and by linking to databases
other bodies of the public sector, which takes place through the Interoperability Center (KED) of the General Secretariat of Public Information Systems
Administration of the Ministry of Digital Governance. For the above purpose, they are available through KED. in the e.F.K.A. online services.
6. Personal data protection issues
For the purposes of this application, the Electronic National Social Security Agency (e-EFKA) operates as a Responsible Processor, in accordance with the provisions of the General Regulation for Data Protection (GPA) and must comply with all obligations arising from the General Regulation on Data Protection (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GCC), as well as the provisions of Law 4624/19.
In the context of the operation of the above platform, personal data related to the following categories are processed by e-EFKA
Subjects:
(i) natural persons registered in the register of certified professionals;
ii) e-EFKA policyholders,
iii) e-EFKA employees.
The categories of personal data processed by e-EFKA for the above categories of Subjects are:
i) For certified professionals:
a) identification data,
b) contact details (mobile and e-mail),
c) registered office address;
d) registration number of a bar association or professional identity number of an accountant – tax expert of the first class,
e) any personal data required of them in accordance with applicable law.
ii) Regarding the insured of e-EFKA:
a) identification data,
b) contact details (mobile and e-mail),
c) home address,
d) marital status data,
e) data related to working life (eg time of commencement of insurance, any data related to private insurance, years of employment, etc.);
f) any personal data related to the implementation of the social security legislation and which is aware of the e-EFKA based on it,
g) any personal data sought through the interfaces with the databases of other public sector bodies, carried out through the Interoperability Center (KED) and exclusively for the purposes hereof.
iii) Regarding the employees of e-EFKA:
a) identification data,
b) position,
(c) other data arising out of or in connection with the registration process carried out through the platform.
The contact details of the insured of e-EFKA and the certified professionals are extracted from the National Communication Register if they are registered. Otherwise, the contact details of the insured of e-EFKA are obtained from the electronic retirement application and the contact details of the certified professionals are obtained from the relevant Bar Associations or the Economic Chamber of Greece.
For the purpose and the legal basis of processing, the provisions already provided apply. E-EFKA has the obligation to take and continuously observe the appropriate and necessary technical measures of information security and, at a minimum, to record and monitor accesses, to ensure traceability and to protect the moving data, personal or non-personal, from any violation, as well as by intentional or accidental threat.
During the execution of each process that concerns the productive operation of the platform and is described in this decision, the competent services of e-EFKA apply all the organizational measures defined in the previous articles. The administrators and users of the above platform have the obligation to use the received information exclusively for the purpose described in this decision.
Personal data shall be kept for the period specified by the social security legislation.
7. Entry into force
This Decision shall enter into force upon its publication in the Government Gazette. By decision of the Commander of e-EFKA is determined the start of operation of the special platform
