Huawei Appeals Swedish Court Decision to Exclude 5G Equipment

Huawei has appealed the court ruling that allowed Swedish telecoms regulator PTS to resume auctions for 5G spectrum while hoping to exclude the Chinese telecom equipment maker from its 5G equipment suppliers.

On December 16, a Swedish court upheld PTS’s appeal against the order to end the auctions and said Huawei could challenge the decision to exclude it from the list of companies involved in the rollout of 5G networks in the country.

“On January 5, Huawei filed an appeal with the Supreme Administrative Court,” the Chinese company said, adding that the regulator had decided to exclude without hearing Huawei, which is contrary to core European regulations.

PTS hoped to resume 5G spectrum auctions on January 19. They were put on hold as a protest from Huawei led to an injunction.

Huawei has found an unexpected ally. The company is supported by a competitor represented by Ericsson

The United States is pressuring allies to ditch Huawei’s 5G equipment, under the pretext of risking it being used by Beijing for espionage. Huawei has repeatedly denied these allegations.

In October, Sweden decided to ban the use of Huawei and ZTE equipment on 5G networks. By January 1, 2025, companies participating in 5G auctions must remove their equipment from the existing infrastructure.
