Hungary and Poland are appealing to the EU Court of Justice

They are appealing to the Court of Justice of the European Union Poland and Hungary against the mechanism linking the allocation of EU budget resources to compliance with the rule of law, a mechanism adopted at the December European Summit.

“We believe that such solutions are not based on the Treaties, are interference in the competences of the member states and violate its legislation,” the Polish government said in a statement.

“This legislation of the European Union, which constitutes a serious violation of the law“It can not remain in force,” Hungarian Justice Minister Judith Varga said in a message posted on Facebook, announcing the Hungarian appeal.

The Member States of the European Union can appeal to the Court of Justice of the European Union to consider whether a regulation is lawful under European law in order to delay its implementation.

Both Hungary and Poland are being investigated in infringement proceedings by the European Commission for violating the rule of law undermining the independence of the judiciary and the press, among others.
