“I want justice,” says Palmeirense fan father who died in 2023

“If I die for my palm trees, I’m happy.” The phrase was said several times by Gabriela Anelli, a fierce fan of the alviverde team. But the young woman’s father could never imagine that this would indeed happen. “I was angry with her and said: No one will die,” said Ettore Amchian Neto.

He came from Curitiba with his wife, mother -in -law, and daughter -in -law to accompany the jury court, who will decide if the flamenco fan Jonathan Messias Santos da Silva is guilty of Gabriela’s death. The hearing began at 10:30 am on Monday (19), at the Barra Funda Criminal Forum, in the west of São Paulo.

Jonathan is accused by the prosecutor of being responsible for throwing the glass bottle, whose shattered hit the fans’ neck, causing his death. She was rescued, but died two days later for bleeding. The crime to which it responds is willful homicide (when the risk of killing), in the eventual intent of futile deceit, was committed, as it was committed motivated by hatred by the opposing fans.

“My expectation is what every father who loses a daughter victim of a murder wants right? Justice. May he be convicted and serve the act that destroyed an entire family, right? And to this day, my wife and I can’t recover,” his father was thrilled to be exclusive to CNN during the jury break.

He and his mother -in -law recalled Gabriela’s passion for Palmeiras, a passion she inherited from her father. Since he was 4, Gabriela has become accustomed to going to the stadiums and at 23 she had the same brightness in her eye. Whenever she had Palmeiras game, she woke up early and got ready. “It’s going to open the stadium gate,” joked the father who can now no longer attend Allianz Park since his daughter’s death.

“There I spent a lot of happy and sad moments with her, in the victories and losses. But I can’t get in there anymore. I got to a day, I was ten minutes and left, because I looked at the little place where she always liked to stay… my passion for Palmeiras continues. It was not Palmeiras who did it, it was a flamenco fan who expects to be convicted.

Grandmother Joana Anelli dos Santos, with tears in her eyes, said she suffers from her older granddaughter. “Every day she called me, send me audio asking for a rain cake, if she had a lunch for her (…) a girl full of life, she had decided to go back to school, made the enrollment and was in love with Palmeiras. I think this is not defect.

Lack of security in the stadiums

Father and grandmother also appealed for football clubs to offer fans more security.

“The only thing we ask is that soccer clubs give more support and security to their fans. The biggest good of the club is the fan. The players one day go and the fan is eternal.” vents Ettore.

Remember the case

Gabriella Anelli died after being hit by a glass bottle in the neck, during a confusion between rivals near Allianz Parque, in São Paulo, on July 8, 2023. The incident took place during a match of the Brazilian Championship between Palmeiras and Flamengo.

The victim was hospitalized in serious condition, but could not resist the injuries and died two days later. The report of the Forensic Medical Institute indicated that death was caused by “traumatic external acute bleeding.” Another fan was also injured in the confusion.

Initially, a suspect had been arrested by the incident. However, this arrest was revoked after the introduction of videos to the authorities who suggested that the glass bottle would have been thrown by someone else.

Jonathan Messias Santos da Silva was indicted by police for willful murder in the event of eventual intent for futile reasons. The Court of Justice of the State of São Paulo (TJ-SP) accepted the complaint of the prosecutor, making it defendant.

Judge Marcela Raia Sant’Anna has converted Jonathan’s temporary arrest to pre -trial detention, understanding the measure as essential for the guarantee of public order, due to the severity and heinous nature of the crime, motivated by hatred for the opposing fans.

In February 2024, the São Paulo court decided that Jonathan Messias Santos da Silva would be tried by a popular jury. The judge upheld pre -trial detention, denying the right to appeal in freedom, citing the severity of the crime and the fact that the defendant went to his state without presenting himself to the authorities.

Investigation

After investigations, São Paulo police pointed out Jonathan Messias as responsible for the death. It was identified as the main suspect through facial recognition cameras installed in the internship region. Jonathan was arrested at his residence in the neighborhood of Campo Grande, in Rio de Janeiro, on July 25, and later taken to Sao Paulo to give testimony.

Jonathan Messias was a teacher and deputy director of a municipal school in Rio de Janeiro. He had no criminal record before this case, and after his arrest, the Rio de Janeiro City Hall departed him from his duties.

Police investigations, including video analysis, led to the conclusion that Jonathan Messias was the only one to throw a bottle as Gabriela was hit.

The images show Jonathan taking a bottle on the floor and throwing it through the space between the siding sides that separated the fans. The police performed an audio and sound synchronization with the videos to identify the moment of throwing and exclude other possibilities.

The delegate responsible said that, after throwing the bottle, Jonathan changed clothes before entering the stadium, when he was identified by facial recognition.

DHPP’s director, Delegate Ivalda Aleixo, said that the work of the expertise and investigation indicated that the object thrown by Jonathan is the only one who could have hit the fan. She countered the allegation of the defense that the videos were edited, stating that they took the videos of the moment of interest without editing.

3D Analysis

A 3D expert analysis was carried out by the São Paulo Criminalistics Institute to recreate the accident. This expertise used notes, conventional and drone aerial photographs, a laser scanning of the site, and videos of witness cell phones.

The result of 3D analysis stressed the possibility that Jonathan Messias Santos would have thrown the object that hit Gabriela. The 3D expert report noted that Jonathan was in a place with good visualization and that the launch was made towards an opening on the metal sheets, even with the presence of metropolitan civil guards and others in the trajectory.

The gate span was approximately 0.70 meters and was about 3.15 meters from Jonathan at the time of launch. The experts concluded that the images “robbed the possibility already mentioned in the previous report” that Jonathan threw the bottle. This expert analysis would still be confronted with other interpretations, such as the IML report and police investigation data.
