The debate over permission to import seeds from cannabis for cultivation, directed to medicinal treatment, may have a verdict in Supreme Court of Justice on trial this Wednesday (13). The SJT analyzes the special appeal, which aims to guarantee the right to import the plant’s raw materials.
On the one hand, the discussion addresses the potential benefits of medical cannabis, not only for health, but also for the industry and the economy. On the other hand, there are arguments about the risks of unrestricted authorization for the import of seeds and the cultivation of the plant.
Bills were analyzed and are being processed in the Chamber of Deputies. In 2021, the Special Committee approved PL 399/15 with a favorable opinion on the legalization of cultivation in Brazil, exclusively for medicinal, veterinary, scientific and industrial purposes. The project waits to be voted on in plenary.
Who can be favored
The release of medicinal cannabis cultivation in Brazil can benefit a wide spectrum of society, including patients, industry, researchers, in addition to allowing state regulation, allowing the control and taxation of imports, exports and domestic consumption.
For patients, the main focus of the process judged by the STJ, people with chronic pain, epilepsy, in addition to neurodegenerative diseases, will be able to rely on cannabis-based products. The availability of national products and own cultivation can guarantee easier and cheaper access to these treatments.
For industry, the production of cannabis-based medicines can generate new jobs and boost the economy and domestic market, in addition to projecting exports to countries that allow the cannabis business. The release is an opportunity for Brazilian pharmaceutical companies to commercialize innovative products, increasing the sector’s competitiveness.
In turn, research ends up favoring the production and development of products, as it feeds the basis of this mechanism.
The legalization of cultivation would facilitate scientific research on medicinal cannabis, allowing a better understanding of its therapeutic effects and the discovery of new indications.
In tax terms, regulating the cultivation and production of medical cannabis could generate revenue for the government through taxes and fees. On the other hand, the action of organized crime linked to drug trafficking would be a challenge, but also a possible indirect benefit.
