In Russia, they propose to automatically write off money for fines


The Ministry of Justice of the Russian Federation proposes to amend the system of collection of fines for traffic violations. In particular, the Ministry of Justice proposes to automatically write off the amount of the fine from the accounts of Russians, and the participation of bailiffs is not required for this.

As conceived by the Ministry of Justice, the modernization of the system of collecting fines will make it easier and faster to punish persistent violators, making it easier for bailiffs to work. Now they have to track drivers with unpaid fines on cameras and regularly conduct joint raids with the traffic police to identify offenders on the roads. And in order to collect fines from the debtor compulsorily, now it is necessary to initiate enforcement proceedings.

However, experts and drivers were wary of the authorities’ proposal. Thus, the head of the working group of the All-Russia People’s Front “Protection of the Rights of Motorists” and coordinator of the “Society of Blue Buckets” movement Pyotr Shkumatov is sure that when describing the advantages of the new system, the Ministry of Justice completely forgets that it can cause a gigantic problem of returning funds to motorists for mistakenly assigned fines … Many Russians will find it easier to keep the money they paid for an erroneous violation than to get a refund, since the current procedure for appealing fines is too complicated. In addition, experts are confident that the reform will create tension in society and encourage drivers to abandon the use of personal bank cards, since the system for automatically writing off a fine without the possibility of a preliminary appeal looks as unfair as possible.

Lawyers interviewed by the portal believe that the proposal of the Ministry of Justice needs to be revised. Firstly, it is necessary to provide for a system of automatic return of collected funds as soon as possible without paperwork in the event that the driver achieves its cancellation. Secondly, drivers should be able to get instant remote access to all information – from the amount written off to the date and place of the offense and photo and video materials on which the moment of traffic violation is recorded in order to avoid walking around offices and paperwork. Also, when the fine is automatically written off from the car owner’s account, lawyers suggest not collecting an enforcement fee either. The main legislative base for the transition to the new regime can be formed by the end of this year. And from next year, bailiffs will be able to switch to digital enforcement proceedings.
