The Savelovsky Court of Moscow dismissed the claim for the return of 16.6 VTS from illegal possession. This was announced by the plaintiff’s lawyer Boris Bashilov, writes RIA Novosti.

According to him, the session lasted an hour, the judge spent “a long time” in the deliberation room, but as a result refused.

The victim intends to appeal the decision.

The fact that the Savelovsky court will consider the claim for the return of the cryptocurrency from illegal possession became known in May.

According to the plaintiff, in the summer of 2018, he transferred bitcoins to his friend Igor Tukan as a trust. He had to invest assets for five months, and then return them to the owner, taking 20% of the return on investment.

However, he later stated that he had lost the cryptocurrency and did not return it. The owner of the bitcoins filed a pre-trial claim, and then a lawsuit.

At the time of the drafting of the claim, the value of the transferred bitcoins was estimated at almost 45 million rubles, at the time of writing – at more than 78 million.

Then Bashilov stated that the case could become a precedent, since such cases were not considered earlier due to the lack of regulation. However, on January 1, the law “On digital financial assets” came into force, recognizing cryptocurrencies as property.
