Indication of Mercadante to BNDES disrespects the law of state-owned companies

If confirmed, the nomination of economist Aloizio Mercadante for the presidency of the BNDES violates the law of state-owned companies.

In its article 17, second paragraph, the law refers to “a person who has acted, in the last 36 months, as a participant in the decision-making structure of a political party or in work linked to the organization, structuring and carrying out of an electoral campaign”.

Mercadante was the economic coordinator of the campaign of president-elect Luiz Inácio Lula da Silva and is a historical figure in the leadership of the Workers’ Party (PT).

The topic has caused enormous confusion in the transition team. As found out by CNN Lula was bothered by the restrictions imposed by law on the appointments he intends to make.

The consultancy Eurasia Group published this morning the information that Lula may publish a provisional measure in his first days in office, altering the law on state-owned companies. The theme has support in Congress, although it faces strong resistance in public opinion.

With the news about Mercadante and the possibility of changing the law of state-owned companies, the market reacted. A little while ago, the Ibovespa fell 2.6%, the dollar rose 1.5% to R$5.32, and interest rates rose.
