Immigration specialist lawyer Vinicius Bicalho stated in an interview with CNN 360° this Wednesday (22) that the indiscriminate attacks on immigrants in the United States are illegal.
According to the expert, American police officers can only approach individuals on the street if there is a “probable cause”.
Bicalho explained: “We have a principle in the United States that is probable cause, that is, the police cannot indiscriminately approach individuals on the street.”
He added that, unlike Brazil, where checkpoints and approaches to ask for documentation are common, in the USA the police can only question a person if there is suspicion of violating some rule or if the individual’s characteristics match those of a criminal suspect.
Impact of Trump’s statements
The lawyer also commented on the impact of former President Donald Trump’s statements on immigration. He regretted Trump’s stance, stating that each statement by the former president “creates chaos, takes away peace from families”.
“The office phone doesn’t stop with every statement from President Trump, because people lose the peace of mind of living, the freedom to come and go,” said Bicalho.
He emphasized that, when talking about immigration, it is about “families, dreams, expectations”.
Despite Trump’s aggressive rhetoric, Bicalho highlighted that, during his previous administration, Trump deported fewer immigrants than Presidents Obama and Biden.
However, the expert criticized the lack of reasonableness in the former president’s statements, which cause anxiety and fear in the immigrant community.
The lawyer concluded by warning that, unless there is a complete change and a total disregard for the law, there should not be indiscriminate approaches to immigrants in the United States.
He reinforced the importance of treating the issue of immigration reasonably, considering the human impact of these policies.
