“I don’t know if you know, but the state of Rio Grande do Sul is one of the states with the largest number of macumba terreiros. Some prophets were already announcing about something that was going to happen in Rio Grande do Sul, due to God’s wrath,” he said on a video at the time. The publication reached more than three million views.

The case judge, Glauco Costa Leite, acknowledged that the Constitution protects freedom of expression, but stressed that it is not absolute. Therefore, Michele’s video characterizes hate speech and hurts the right to religious freedom of the African matrix communities that were responsible for the floods.

Also according to Glauco, the video has exceeded the limits of freedom of expression and generated collective damage to African matrix religions, which are a historically discriminated group, which justifies the payment of a fine of R $ 50,000 for collective moral damages.

The amount will be destined to the Diffuse Rights Protection Fund, as provided for in the Public Civil Action Law (Law 7,347/1985).

In addition, the judge confirmed that the platforms are not responsible for the damage caused by the content, as they have complied with the order to remove the video. The decision was based on the Internet Civil Marco (Law 12.965/2014).
