Irish company Solas OLED complains to ITC about BOE and Samsung Electronics

Chinese display panel maker BOE Technology Group said yesterday that an investigation by the US International Trade Commission (ITC) would not have a significant impact on the company’s current production and operations.

The company plans to follow the investigation, actively negotiate with the relevant parties, and vigorously defend its legitimate rights and interests.

An investigation was launched on a complaint filed on December 28, 2020 by the Irish OLED technology licensing company Solas OLED. In addition to BOE, the complaint also includes South Korean tech giant Samsung Electronics Co Ltd.

The complaint alleges a violation of Section 337 of the Tariffs Act 1930 for the importation and sale of certain active matrix OLED display devices and components into the United States, which infringe Solas OLED patents. Complainant expects ITC to order the violation to cease.

Article 337 defines violations of intellectual property rights and other forms of unfair competition in trade in imported goods. Most of the relevant investigations involve allegations of patent or registered trademark infringement.
