Itapemirim Transportes Aéreos was ordered to pay R$ 3 million for the failure to provide services, such as the suspension of flights and lack of assistance.
The decision, by the National Consumer Secretariat (Senacon/MJSP), allocates the amount to the Fund for the Defense of Diffuse Rights (FDD), which directs to projects of collective interests, for example, protection and repair of historical heritage and actions to defend consumers.
“This conviction demonstrates that the Ministry of Justice and Public Security closely monitors the consumer market and adopts the necessary measures to protect and defend the rights of Brazilians. The measure is also an example to prevent cases like this from happening again”, highlights Minister Anderson Torres.
The measure was published in the Official Gazette this Wednesday (4). For the stipulation of the fine, the seriousness of the damage to the consumer, the size of thethe company and gross monthly revenue. The company has 30 days to make the payment and can still appeal the fine.
In December last year, Itapemirim suspended operations in Brazil, canceled 514 flights and left thousands of people injured. Senacon found that it was not complied with the Consumer Defense Code by failing to inform the company’s situation to its customers.
Senacon also assessed that the cancellation rules stipulated by the National Aviation Agency (Anac) were not complied with. In situations such as these, it would be up to the company to re-accommodate passengers, grant a full refund or provide the service to be performed by another modality chosen by the consumer.
Consumers without answers
Since the suspension of operations, Itapemirim has also ceased to respond to complaints submitted on Consumidor.gov.br. For this reason, it was excluded from the platform managed by the MJSP.
Before the exclusion from the system, 5,033 complaints had been registered this year. In 2021, there were 1,624. With the deactivation, the company remains visible in the system so that the history of dissatisfaction remains public and accessible.
