Ius Scholae, what it is and how it works

The Chamber of Deputies discusses the proposed citizenship law which aims to introduce it Ius Scholae. What does it mean? It means give Italian citizenship to children of non-EU citizens who have attended a school cycle in Italywithout having to wait to turn 18.

Within the schools there is no such difference, the children do not feel it, but according to the law there are tens of thousands of children who do not have the same rights as their comrades. Politics has known this for some time. Already in 2015 the bill on the Ius Culturae. A law has never been reached, if not the partial one of Ius Soli sporty.

The latest figures Istat they say that there are more than a million foreign minors in Italy: 11.5% of the resident population under the age of 18. There are over 870 thousand students of foreign origin in the Italian school. Almost two thirds of them were born in Italy.

For them it was thought at the beginning of the Ius Solinow it is Ius Scholae. Italian citizenship comes after five years of school. The Constitutional Affairs Commission of the Chamber, with also the votes of Forza Italia, adopted the basic text on the reform of citizenship. The new law would give, after the completion of 5 years of study in Italian schools, Italian citizenship to minors of foreign origin, who were born in Italy or arrived before the age of twelve. For many it is an ius soli (sunk in 2015 in the Senate after the yes of the House) mitigated, not automatically recognizing citizenship.

Now a child is Italian if one of the two parents has Italian citizenship. Those born in Italy of foreign parents can apply for citizenship only after having reached the age of eighteen and having resided in Italy legally and without interruption. According to research by ActionAid 62% of people don’t know what it is Ius Scholaebut 6 out of 10 Italians declare themselves in favor according to the survey by YouTrend. He also says yes to 48 per cent of those who declare themselves to be voters of the League and 35 per cent of those of the Brothers of Italy. They are the two parties that have always opposed the bill and have presented hundreds of amendments to the Commission, rejected, (from the knowledge of the patrons to popular traditions, from music to history passing through the school average), supported instead by Pd, Liberi and Uguali , M5s and Forza Italia.

The consolidated text issued by the Commission says that a foreign minor born in Italy or who entered the country before the age of 12, who resided legally and without interruption in the country, has the right to citizenship, after having regularly attended one or more school cycles for at least five years. Citizenship can be requested by parents or by a minor within two years of turning 18 years of age. Registry officials have the duty to communicate to potentially interested families the possibility of applying for citizenship in the six months preceding the age of 18.

The law had as speaker the chairman of the Constitutional Affairs Commission of the Chamber, Giuseppe Brescia, of the 5-star Movement. For the Democratic Party it is a priority. The League and the Brothers of Italy are preparing to obstruct the House and there is still the next step in the Senate, where the numbers are even more limited.
