Former councilor Jairo Souza Santos Junior, known as Doctor Jairinho, and Monique Medeiros will go to popular jury for the death of the boy Henry Borel, son of Monique. The crime took place in March 2021.
The decision, which responds to a request from the Public Ministry, is by Judge Elizabeth Machado Louro, of the 2nd Criminal Court of Rio de Janeiro. She also ordered the maintenance of Jairinho’s provisional detention and the release of Monique Medeiros, who will await trial in freedom with the revocation of preventive detention.
The judge claimed that Jairinho should remain in prison due to the “need to ensure public order”, since, according to her, the likelihood of him committing new similar crimes is confirmed.
In relation to Monique, Elizabeth claimed that she was imprisoned for two months without failing to comply with the established conditions and, therefore, had the request for habeas corpus granted.
Jairinho’s defense, among other allegations, disputes the expert reports and denies that there was a homicide. The judge, however, says that cadaveric examinations and the report of the simulated reproduction of the crime ensure that the clinical state in which Henry arrived at the hospital was not motivated by a domestic accident.
In the same decision, the judge also acquitted Monique and Jairinho for the crime of procedural fraud. Monique was also acquitted of charges of torture and misrepresentation, and Jairinho, of the crime of coercion in the course of the process. The two now answer for the crime of murder.

Monique is accused, along with her then-boyfriend, Doctor Jairinho, of having participated in the death of her son, Henry Borel, 4, on the day 8 of sea2021.
The boy died after being taken unconscious to the hospital by the two. The suspicion is that the child was assaulted by Jairinho. However, he and Monique deny that there was any assault on Henry. In their version, the boy was injured when he fell out of the bed where he slept.
