João Alberto case: defendants for murder at Carrefour in Porto Alegre go to jury

The six defendants accused of the murder of João Alberto Silveira Freitas in a unit of the Carrefour supermarket, in Porto Alegre, in the year 2020, will go to the popular jury.

The decision was made by Judge Lourdes Helena Pacheco da Silva, from the 2nd Court of the 2nd Jury of the Central Court of the District of the Capital.

The accused Kleiton Silva Santos, Magno Braz Borges, Adriana Alves Dutra, Giovane Gaspar da Silva, Paulo Francisco da Silva, Rafael Rezende are responsible for triple-qualified homicide (awkward motive, cruel means and resource that made it difficult for the victim to defend himself).

João Alberto was murdered after shopping at the supermarket with his wife, Milene, on November 19, 2020.

During the period he remained at the establishment, the black man was monitored by the security team and ostensively accompanied, according to the complaint.

While leaving the place, João Alberto was followed and, after a provocation by Giovane, a physical clash began. The expert report pointed out that the victim was killed by chest compression that caused asphyxiation by indirect suffocation.

Magno, Giovane, Kleiton and Rafael would have actively participated in the attacks. Adriane, who appears as head of the security team, and Paulo would have acted preventing the man’s wife and other people from approaching to interrupt the action.

At the time of the events, one of the witnesses, who was a Carrefour employee, reported that João Alberto had previously had problems with the store’s inspectors.

What the defenders say

Giovane’s defense claimed self-defense, as João Alberto would have started the fight by throwing a punch. Magno’s defense maintains that the defendant did not act with malice, that is, intention.

Adriana’s defense asked for her acquittal, stating that she would not have a higher position than the other accused. Giovane, Magno and Adriana are under arrest, with the woman under house arrest.

The theses were not accepted by the judge.

Regarding the defendants Kleiton, Rafael and Paulo, the magistrate understood that both adhered to the aggressions practiced by de Magno and Giovane, under the command of Adriana.
