The judge from the US state of Delaware who is leading the case over the purchase of the twitter per Elon Musk decided that the billionaire may amend his lawsuit to incorporate allegations from Peiter Zatko, a former head of security at the company.
The judge denied Musk’s request to postpone the trial in the case from October 17 to the month of November.
In a ruling on Wednesday (7), the judge cited a rule of the Court of Chancery that permission to include amendments to the process must be “freely given when justice requires it.”
In the whistleblower’s complaint, filed with the Securities and Exchange Commission (SEC, equivalent to the CVM ) in July and made public last month, Zatko accuses the company of failing to protect sensitive user data and lying about its security issues.
The complaint provides new ammunition to bolster what legal experts said was an attempt by Musk to get out of the deal without paying a $1 billion termination penalty.
In July, Twitter sued Musk for suspending a $44 billion deal to buy the company, which it closed in April.
In response, Musk has filed a lawsuit in which he accuses the company of making up the platform’s business conditions and key user metrics.
