A US federal judge has expanded temporary blockade to the federal government to use an authority adopted in periods of war to quickly deport some immigrants that the US accused of being affiliated with the Venezuelan gang Tren de Aragua.
District Judge James Boomberg prevented the government on Saturday afternoon from deporting five individuals who are contesting the use of the so -called “Alien Enemies Act” by President Donald Trump to accelerate deportations.
Following a hurry -giving hearing hours later, Bomberg granted a lawyers’ request to certify a “provisional class” that encompasses all non -citizens under US custody that would be subject to Trump’s proclamation.
Bomberg, who acts as a chief judge of the Federal Court of First Instance in Washington, DC, agreed that the deportations of these individuals should also be temporarily blocked while the process follows.
“I think there is clearly an irreparable damage here, as these people will be deported. A brief delay in its removal does not cause any damage to the government, ”he added.
“Particularly given the information of the plaintiffs, not refuted by the government, that flights are actively departing and planning to leave, I do not believe I can wait any longer,” continued Bomberg.
“Any plane containing these people who will take off or are in the air needs to return to the United States,” he said.
The judge pointed out that the order of temporary restriction will remain in force for 14 days “or even new court order.” He marked another audience in the case for the end of this month.
The Justice Department has quickly appealed from the previous order of the judge and will probably also appeal to his last decision.
