The Special Body of the Court of Rio de Janeiro (TJ-RJ) decided, on Monday (14), unanimously for the compulsory retirement of Judge João Carlos de Souza Correa. The measure was adopted as an outcome of a Disciplinary Administrative Proceeding (PAD) established by the Court’s General Corregedoria in November 2021, after a complaint filed by the Public Prosecution Service.
Despite the removal, he maintains the right to receive compensation and benefits. There is still an appeal of the decision.
Sought by CNN, the defense of the judge pointed out that “he has more than 30 years of exercise of the judiciary and his life story stands like a shield in the face of this accusation.” The lawyer attributes the conviction to the “mistaken interpretation of the facts and evidence presented”. He stresses that this is not a final decision.
The magistrate’s representative also reported that “he considers himself a victim of an unfair and unfair accusation and trusts that he will be acquitted of appeal.”
Investigation into sculpture theft
The PAD learned the conduct of the magistrate in an episode in 2014, in the historic city of Tiradentes, Minas Gerais. At the time, security cameras recorded the moment when the judge entered an antique store, removed a sacred art statuette – an image of Our Lady of Conception, at the time an average of $ 4mil – and put it in her vehicle. During the lawsuit, the judge’s defense claimed that the play had previously been acquired by his mother and that he would only have been seeking her at her request. He also argued that there was authorization from the store to remove the object and that there was no theft. The magistrate denied any debt with the establishment and declined a proposal for an agreement in the amount of R $ 7,200.00 that aimed to terminate the controversy.
