Judge Samantha Mello, from the 5th labor court of Santos, ordered the pawning of luxury items from a woman who has a labor debt since 2010, in the amount of 30 thousand reais.
In the decision, the magistrate used as evidence, photos in which the defendant posted on the internet boasting luxury purchases, handbags, cars, designer clothes and a high standard house.
In the document, the judge alleges that: “In fact, it is a beautiful and luxurious house, as well as the life of the executed demonstrated through social networks, in which she appears on international trips, wearing haute couture clothing, having aesthetic procedures, with a sumptuous and refined standard of living, certain that the appellant does not lack financial means – less obviously, to satisfy the debts of this process, which, I presume, the debtor does not seem to be concerned about – not least because concern is not a common feeling for who is going to visit the “City of Light”, said the judge, adding a photo of the woman traveling to Paris to the file.
In addition to the luxury items that appear in the woman’s posts on the internet, such as a Chanel bag and a Louis Vuitton coat, the court ordered the auction of the house where the defendant lives, valued at R$2.2 million, and the seizure of the defaulter’s passport and driver’s license.
In addition, the magistrate condemned the woman to pay a fine of 20% of the value of the case for an act that violated the dignity of Justice, due to the attempt to delay and defraud the execution of the sentence, since the defendant avoided receiving the bailiff .
“What you see, therefore, is a clear asset shielding, without any interest of the debtor in settling the credit, said the judge in the decision”.
The magistrate also points out that in June last year, the defendant appealed in court claiming the unseizability of the house where she lives.
But the request was rejected and in the process the judge points out that in the same month of the action, she posted a photo on social networks wearing a Louis Vuitton coat that alone would be able to settle the debt.
The judge points out in the case file the link to the brand’s store, where the coat alone costs more than R$ 38,000 and still jokes:
“On January 4, 2023, to start the year off right, as the expression “on the right foot” says, nothing better than also wearing a LOUIS VUITTON on your foot: But there’s also room for CHANEL – how not to love it, isn’t it? same?
In another part of the case file, the magistrate says that while she was writing the debtor’s sentence, she “in her stories showed her purchases made and spoke the motto adopted in her daily life: “money does not bring happiness, but it buys”.
