Substitute judge Monica Ribeiro Teixeira, from the 6th Special Civil Court of the District of Capital Lagoa (Rio de Janeiro), argued for the dismissal of a lawsuit filed by singer Chico Buarque against federal deputy Eduardo Bolsonaro.
The argument pointed out by the magistrate was the fact that the singer did not prove to be the author of the song “Roda Viva”, the subject of the debate.
“The absence of a document essential to the filing of the claim, that is, a document capable of proving the applicant’s copyright on the song “Roda Viva”, is cause of ineptness and rejection of the complaint…”, says the order of the 18th of November.
Chico Buarque decided to go to court after Eduardo Bolsonaro used the song in a publication on social networks, with an image of supporters of the president and the question that Brazil was living under censorship.
Lawyer for Chico Buarque, João Tancredo informed that he has already filed an appeal against the judge’s decision.
“I can only credit ignorance. Chico Buarque is not charging material rights, he is not charging a fee because his music was used. He is charging moral damages because the deputy is improperly using his work”, he told CNN about the magistrate’s manifestation.
In the appeal, the singer’s defense points out that “the composition of the work and the recording of the music by Chico Buarque is a public and notorious fact”. “It is one of the most striking songs in Brazilian popular culture and in the history of protest songs”, the document also highlights.
