Judge Luis Cesar de Paula Espíndola, from the Court of Justice of Paraná (TJ-PR), was removed from office this Wednesday (17). In a session earlier this month, which analyzed a case of harassment against a 12-year-old child, he stated that “women are crazy about men”.
The decision to remove him was made by the National Justice Inspector, Minister Luis Felipe Salomão. “The magistrate’s conduct, according to what has been determined so far, has seriously tarnished the image of the Judiciary, with an evident loss of confidence in its performance by those under its jurisdiction,” he concluded.
According to the inspector, the decision was “established” together with the president of the National Council of Justice (CNJ) and the Federal Supreme Court (STF), Minister Luis Roberto Barroso.
“Given the seriousness of the case and the pressing need to prevent future situations in the event that the Judge remains at the head of the Chamber that acts on this same matter, with repeated attitudes of opposition to the policies and regulations adopted by this Council, I note that I maintained a dialogue with the Presidency, Minister Luis Roberto Barroso, when the urgency and seriousness of the situation was reaffirmed, demanding the need for the measure now determined, jointly initiated”, highlighted Salomão.
Regarding the possibility of removing the judge, according to the minister, it will only be analyzed after the trial of the Disciplinary Complaint opened to investigate the case. This includes the presentation of a defense by Espíndola.
In a statement on the day the incident occurred, the judge said that he “did not intend to belittle female behavior”, arguing that he had always defended equality between men and women in his personal life and in his decisions.
“I deeply regret what happened and I stand in solidarity with everyone who felt offended by the partial release of the video of the session,” he said.
