The courts of Justice go into recess from this Friday (20th) and will only reopen on the day January 6, 2025 a Monday.
The interruption of working hours is determined by law no. 5,010/66, which establishes the period as a holiday including for higher courts.
And what are the processes like? There are differences between civil and criminal actions in Brazil.
According to the Code of Civil Procedure, the procedural period will be interrupted between the days December 20th and January 20th, 2025.
During this period, there will be no hearings or trial sessions in accordance with law no. 13,105/15. This means that the progress of the processes will be suspended between the dates.
However, judges, members of the Public Ministry, the Public Defender’s Office, the Public Attorney’s Office and court assistants perform their other duties in the period.
In the criminal area, the course of proceedings is also suspended between December 20th and January 20th, except in actions involving:
- defendants arrested in the processes linked to these prisons
- procedures governed by Maria da Penha Law
- measures considered urgent through a reasoned order from the competent court
The guidelines are from the Criminal Procedure Code, decreed on October 3, 1941. These exceptions were included in the legislation only in June 2022.
