Justice allows SP city hall to continue monitoring 99 motorcycle taxis

The Court of Justice of São Paulo determined that the City Hall of the capital of São Paulo You can continue monitoring the 99 motorcycle taxi service.

In a decision handed down this Monday (20), judge Eduardo Gouvêa rejected an injunction from the company that requested the removal of the determination made by the City of São Paulo.

The rapporteur explained that the “Federal Constitution gives municipalities the power to legislate on matters of local interest”. 99 tried to prevent the inspection with an interlocutory appeal, a legal resource used to challenge a judge’s provisional decisions.

The company also argues that municipal decree nº 62,144/2023 is illegal and unconstitutional, addressing a matter that is the exclusive responsibility of the Union.

The City Hall, however, states that 99 does not cite an article from the National Urban Mobility Policy which establishes that it is the exclusive responsibility of municipalities to regulate and supervise the paid private individual passenger transport service. The excerpt was cited by the judge in the decision.

In a note, 99 regretted the judge’s provisional decision and reaffirmed that 99Moto will continue to operate.

“Private transportation by motorcycle remains supported by federal legislation and municipalities do not have the power to prohibit it, as already decided by the STF and recognized by around 20 judicial decisions across Brazil. 99 will continue to adopt all legal measures to ensure the rights of the company, its users and partner motorcyclists in São Paulo”, states the company.

The municipal administration reiterated that “paid transportation by motorcycle via app is prohibited by municipal decree of 2023″ and is “clandestine” . City Hall reported that 143 motorcycles have been seized since January 15th.
