The Federal Regional Court of the 4th Region decided to resume the specific selection process for transgender students at the Federal University of Rio Grande (FURG), which is located in the state of Rio Grande do Sul. The decision reformed a previous injunction issued by the Federal Court of Rio Grande do Sul, which determined the suspension of the process.
With that, the institution released the list of the nine candidates approved in the entrance exam. They must enroll in courses in Business Administration, Visual Arts – Bachelor’s Degree, Visual Arts – Bachelor’s Degree, Biological Sciences – Bachelor’s Degree, Night Law, Physical Education, Nursing, Medicine and Psychology.
In a post on social networks, the rector of FURG, Danilo Giroldo, stated that the decision will contribute to a more plural institution and society.
“These people will help us to be a better university, better academics and better people, because the more diverse and inclusive the spaces are, the better, more powerful and more representative of society they will be. In other words, we will be a better institution based on these students”, he pointed out.

In October last year (2022), the Federal University of Rio Grande announced the opening of registration for a specific selection process for transgender students. The announcement opened 10 vacancies for this public.
The decision took into account the search for expanding the Affirmative Actions program.
According to a note from FURG, “the action is part of a program that also encompasses other socially disadvantaged and historically excluded groups such as indigenous peoples and quilombolas, for example, each with a specific selection process, offering vacancies based on a pre-conceived dialogue with the representative bodies”.
After the announcement, two lawyers, one a resident of Rio Grande (RS) and the other a resident of Aquidauana (MS), filed a lawsuit to challenge the selection process.
The lawyers claimed that “By establishing quotas for transgender people within graduation, FURG enters the sphere of creation of rights, that is, the legislative sphere, even without having the competence to do so”.
On February 27, 2023, the 2nd Federal Court of Rio Grande granted an injunction suspending the effects of the University’s resolution and competition.
FURG then resorted to TRF4. On March 3, 2023, Judge Roger Raupp Rios accepted an appeal filed by the Attorney General’s Office (AGU) and suspended the injunction, therefore determining the continuation of the selection process.
According to the magistrate, “it is necessary to consider the inclusion of transgender people among the recipients of affirmative actions”.
The judge also based his decision on a previous understanding of the Federal Supreme Court with the “recognition that qualifies transgender people among the recipients of affirmative actions, given their past and current historical experience among ‘socially disadvantaged groups’”.
