Justice denies Holiday’s request and maintains Ludmilla’s cache for Virada Cultural

The Justice of São Paulo denied the request of the councilor Fernando Holiday (New) and decided to keep the payment of the singer’s concert fee ludmilla at the Cultural Virada in São Paulo.

“The decision is duly substantiated and the existing evidence, for this procedural stage, does not allow to conclude by the evidence of the right or even the possibility of suspension of payment, considering that the provision of the service was carried out”, writes the decision, published in the Diário de Justiça do Estado de São Paulo (DJSP), this Monday.

“For these reasons, the intended active suspensive effect is rejected”, concludes the decision.

The councilor justified his request by saying that Ludmilla had violated electoral rules and made political propaganda for former president Lula (PT) by making the “L” gesture with his hands during the show, which took place in May.

Holiday wanted the fee to be suspended or refunded by the singer, but the court ruled that there is not enough evidence to support the allegation.

For Ludmilla’s performance at Virada, the City of São Paulo paid R$ 222 thousand.

In the process, the City of São Paulo argued that the symbol made was not linked to the PT, but to the initial of the singer’s name.

Ludmilla gave the same justification through social networks, and the singer’s advice told the CNN, showing old videos, which she has made the gesture for years in her performances.

When subpoenaed by the Justice, the Federal Public Ministry (MPF) said that “it pleads suitability of the passive pole to include the authorities responsible for the contested act” and also stated “that there are no elements that corroborate the deviation from the purpose of the show”.

THE CNN tries to contact São Paulo City Hall, singer Ludmilla and councilor Fernando Holiday to comment on the decision.
