Justice denies request for freedom of former deputy Flordelis, sentenced to 50 years

The Court of Justice of Rio de Janeiro (TJRJ) denied, on the afternoon of Tuesday (29), the habeas corpus request of former deputy Flordelis.

Last November, she was sentenced to 50 years and 28 days in prison for triple homicide, attempted double homicide, in addition to using a false document and armed criminal association. The crimes were committed against Pastor Anderson do Carmo in June 2019.

According to the rapporteur for the request, Judge Peterson Barroso Simão, there was no excess of time for processing the case, as argued by Flordelis’ defense.

Simão also highlighted that any delay was due to the complexity of the case, the number of defendants and procedural incidents caused by the defense of one of the co-defendants.

In his vote, the judge refuted the allegation that there was no periodic review of the preventive detention, indicating that such review was carried out before the plenary session and that the review responsibility now falls on the Criminal Execution Rod.

Simão also maintained that the maintenance of preventive detention is justified by the dangerousness of the defendant and the “need to guarantee public order”.

“The denial of HC was already expected by us. We are talking about the excess of time since the jury took place until today, that her appeal was not judged. So the HC is just related to that. What we have confidence in the Court of Justice is that when the appeal is judged, that the appeal is valid and that the trial session is annulled so that it can be submitted to a new jury”, brings the note.
