A transgender woman managed with the Goiás Court of Justice (TJ-GO) right to have facial feminization surgery through the health plan if unprecedented in the state.
The decision occurred in the context of an appeal filed by the State Public Defender’s Office (DPE-GO) to a sentence that classified the procedure as aesthetic.
The Defender’s Office argued that the surgical procedure is essential for the gender transition that the public servant has been going through for over 10 years. The Ipasgo Saúde Plan had denied the request based on the absence of coverage by the National Health Agency (ANS).
The first judgment of October 2024 considered that the procedure would be an “aesthetic and experimental medical intervention” and therefore elective and not essential.
The judge of the case, Ricardo Prata, understood that the prescription proves the need for surgery and is a therapeutic measure to relieve the suffering caused by gender incongruity. The magistrate also stressed that the list of ANS procedures is not exhaustive.
The decision is on April 3 and had unanimous support from the 7th Civil Chamber judges.
The woman, who prefers not to identify herself, points out that her process with gender identity began in 2011, when she was accompanied by the then TX project, from the Federal University of Goiás Hospital das Clínicas (UFG). During her transsexualizing process, she was diagnosed with gender dysphoria, a condition recognized by medicine.
“Gender dysphoria becomes a matter of mental health from the moment you do not feel safe with yourself, you do not feel represented in your image when you see yourself. And this place puts trans and transvestite people susceptible to all forms of violence, verbal, physical, psycho -emotional,” she says.
The need for facial feminization surgery was attested by doctors as a fundamental part of its transsexualizing process. Given the negative health insurance, DPE-GO filed a lawsuit that requested the surgery with full coverage by the health plan last year.
In the petition, the public defender Ketlyn Chaves, sub -coordinator of a homeless person and LGBTQIAPN+ of the Specialized Human Rights Center (NUDH), stressed that “long before improving the appearance, surgery aims to affirm the genre, included in the concept of integral health of human being, as a measure of illness prevention”.
