One LIMINARY DECISION OF THE JUSTICE OF RIO GRANDE DO NORTE determined that Detran-RN immediately suspendes the collection of the National Driver’s License (CNH) renewal fee for drivers over 65 years.
The measure meets an action of the State Public Prosecution Service (MPRN). In case of non -compliance, a daily fine of R $ 5,000 will be applied, which will be destined to the State Fund of the Elderly.
The State Department of Traffic (Detran-RN) is expected to immediately suspend the collection of CNH’s renewal fee to the elderly.
The injunction was granted by the 1st Tax and Tax Enforcement Court of Natal, in response to a public civil action filed by the 42nd Prosecutor of the Capital, which acts in the defense of the rights of the elderly.
The action is based on State Law No. 10,157/2017, which provides for the exemption of the rate for elderly drivers residing in the state. In addition, MPRN points out that the Elderly Statute reinforces the absolute priority and full protection to the rights of this portion of the population.
The prosecution pointed to illegality in the collection, as well as practices such as deviation of purpose, abuse of power and violation of constitutional principles, legality, impersonality and administrative morality.
According to the MP, the legislation determines that Detran should have regulated the exemption process within 45 days after the formalization of the law, which was not fulfilled. With this, the understanding of the MP is that the collection has become improper, bringing a financial obstacle to the elderly, who now have their right recognized in court.
Before resorting to the judiciary, the MPRN said he tried to resolve the issue by administrative means, through offices and meetings with state representatives.
