Justice grants open regime to Alexandre Nardoni

The São Paulo Court of Justice granted, this Monday (6), the progression of sentence to an open regime for Alexandre Nardoni. The defendant served more than half of his prison sentence after being convicted of the death of his daughter Isabella.

The decision by judge José Loureiro Sobrinho, from the district of São José dos Campos (SP), goes against the opinion of the Public Ministry of São Paulo (MPSP), which claimed that the prisoner does not meet the subjective requirements for progression.

However, the judge stated that the defendant maintains good prison conduct, has a defined procedural status and has served more than half of his sentence. Furthermore, according to the judge, he is taking advantage of temporary releases, returning to prison normally.

Loureiro Sobrinho also mentions that Nardoni had the joint report and evaluation with a favorable opinion and did not register any disciplinary offenses during the sentence, thus fulfilling the objective and subjective requirements required by Law to obtain the benefit.

The TJSP decision also alleges that the defendant has the necessary period of serving his sentence to grant the benefit. The document highlights that the seriousness of the crime is not an obstacle to prison progression.

“And, despite the negative aspects of his personality, highlighted by the Illustrious Representative of the Public Prosecutor's Office, having met the requirements required by law, there is no obstacle to progression due to the seriousness of the crime”, stated the judge.

Exit from the Penitentiary

In contact with CNN, the Penitentiary Administration Secretariat (SAP) reported that the management of Tremembé Penitentiary II complied with the release permit in favor of Alexandre Nardoni, at 5:20 pm, this Monday (6). Nardoni's lawyer, Roberto Podval, told CNN who is “happy to be able to contribute so that Alexandre can return to his life”.

The SP Court determined that the remainder of the sentence be served at the convict's residence until another suitable location is designated. See what conditions the court determined for Alexandre Nardoni:

1 – Appear quarterly at the Criminal Execution Court to report on your activities;

2 – Obtain lawful occupation within 90 days;

3 – Remain at your residence during rest, in the period between 8:00 pm and 6:00 am, unless with judicial authorization;

4 – Do not change the district without prior authorization from the court;

5 – Do not change residence without informing the court;

6 – Do not frequent bars, gambling houses and other places incompatible with the benefit achieved.

Penalty reduction

The 30-year sentence was reduced by 96 days, in October 2023. The reduction refers to the days worked and a book read by the prisoner. There were 277 days of work and reading of the book “Letter to the Father”, by Franz Kafka.

Alexandre Nardoni and Anna Carolina Jatobá were convicted in March 2010 for the death of Alexandre's daughter, Isabella Nardoni, aged 5. The child was thrown from the sixth floor of a building in Vila Guilherme, north of São Paulo, in 2008.

Anna Carolina Jatobá, the stepmother, left prison in June 2023, after the court granted her progression to the open regime.
