A judge in Rio de Janeiro this Thursday (2nd) rejected a request for search and seizure of e-mails from current and former Americanas executives on grounds of competence, in a new development of the crisis generated by the discovery of an accounting breach in the retailer.
The search and seizure was granted by Judge Andrea Palma, of the Superior Court of São Paulo, last week, after Bradesco’s request. However, Judge Alexandre de Carvalho Mesquita, of the 2nd Business Court of Rio de Janeiro, decided to return the letter rogatory – used in communication between judges from different states – that had determined the search and seizure, since “the measure granted by the deprecant court extrapolates its competence”, according to the decision.
In recent days, also in decisions of the Justice of São Paulo, Americanas had an appeal against the search and seizure denied, but, at the same time, it managed to keep the collected evidence confidential.
Americanas is headquartered in Rio de Janeiro. The company filed for bankruptcy in the same state last month, in the face of a crisis generated by the discovery of an accounting breach.
