Justice of Roraima determines suspension of Gusttavo Lima show in municipality

The Justice of Roraima, by means of an injunction, ordered the suspension of the concert by singer Gusttavo Lima that would take place in December this year, during the 24th edition of Vaquejada and 13th Agribusiness Fair in São Luiz, 310 km from Boa Vista. There is still recourse.

The municipality, which is in the south of the state, has only 8 thousand inhabitants and the singer, with the highest salary in Brazil, would be hired by the city hall for R$ 800 thousand reais.

The singer Solange Almeida also had the show suspended by the injunction. The artist had been hired, under the same conditions, for a fee of R$108,000. The court order does not mention the duo César Menotti and Fabiano, hired for R$ 150 thousand, who had the show maintained until then.

In the decision, Judge Rafaella Silveira, from the District of São Luiz, gives a favorable opinion to the action brought by the Public Ministry of the State of Roraima, through the São Luiz Prosecutor’s Office, alleging lack of budget for the high costs of hiring.

“In addition to the high contractual cost with no budget balance in the work program, other expenses provided for in the contracts that were not measured in the preliminary technical studies put public order at risk and can lead to serious economic damage to the municipal coffers”, highlighted the judge.

Now, the city of São Luiz has 10 days to cancel and prove the cancellation of both contracts. The daily fine is BRL 10,000 for non-compliance.

In a note, the city government said it had “all proof of the administrative and financial capacity to carry out the Festejo, but we cannot and will not, in any way, confront the Judiciary. Our legal department is analyzing the next acts, but we will comply with the determination imposed on us”.

The prosecutor, Joaquim Eduardo dos Santos, the author of the action, said he did not intend to prevent the festivities.

“It is not opposing the holding of the festive event, the trade fair or the renovation of the exhibition park, but rather specific contracts that were carried out without complying with legal dictates”, he pointed out.

Public Civil Action was filed in July this year, after an investigation by the Public Prosecutor’s Office that pointed out that hiring was carried out without proof of budget allocation and execution, which is irregular.

The action requested the cancellation of the three shows, which together totaled R$ 1.05 million.

When announced, the event of such magnitude divided opinion. Despite being relatively close to the capital, the city that has the second lowest GDP in Roraima, has little structure to receive so many people.

The city has two hotels, seven restaurants and no supermarket, only neighborhood shops. Only one telephone network serves the municipality.
