Justice orders Xavier García Albiol to house a family he evicted

A judge orders the Badalona City Council to house one of the six families who lost their home and a good part of their belongings a year ago, when the block where they lived was demolished when it threatened to collapse. The Consistory stopped paying for the apartments and the hostel places where they stayed until a few weeks ago. After being evicted, part of those affected have slept some nights in tents.

The Contentious Administrative Court 6 of Barcelona has issued very precautionary measures in favor of a couple with dependent minors. There is no recourse against the decision, a precedent that remains to be seen if it is extended to more victims. After the last stay that the City Council gave them in a neighborhood house was exhausted, the women and children have settled in a premises of the Generalitat, while the men have been camping since Tuesday to demand solutions from the mayor, Xavier García Albiol (PP).

The mayor said it is enough to continue paying for the lodging of the families, who allege that they have not received help to relocate or find a rent adapted to income that they declare meager. Albiol alleges that the municipal coffers have assumed invoices amounting to 320.000 euros. He argues that protecting the evacuees from the demolished building for longer would be a favorable treatment to the detriment of the more than 150 families in Badalona pending access to a social apartment.

The order concludes that “there is a situation of special urgency” for which the family must be sheltered and demands special protection for taking care of minors. The magistrate does not grant a hearing for the City Council to manifest itself before taking the ruling. He reproaches him for not notifying resolutions to those he ended up evicting. Now the City Council is granted three days to pronounce itself.
