The Court of Justice of Rio de Janeiro rejected an appeal by Banco do Brasil and maintained the judicial recovery of Americanas in the 4th Business Court of the District of Rio.
Banco do Brasil had claimed that “given the uncontroversial nature of the business volume (of the Americanas) being centralized in the city of São Paulo and in the light of the jurisprudence of the Superior Court of Justice” it recognized “the incompetence of the 4th Business Court of the Judicial District of Capital of the State of Rio de Janeiro to process and judge the case” and “the decision to send the records to the Court of Justice of the State of São Paulo, for redistribution to one of the Business Courts of the District of São Paulo”.
On Friday night (10), however, the judge of the Court of Justice of Rio, Leila Lopes, rejected the appeal, as she understood that it “does not go beyond the assumption of admissibility”.
This is because the judge of the 4th Court has not yet decided on the issue based on the provocations via embargoes that were made by the banks.
The judge’s decision, however, is an indication that the second instance in Rio is contrary to the allegations of the Americanas’ creditor banks that the case should be judged in São Paulo.
