Justice revokes house arrest and police officer who killed PT treasurer will go to prison

the justice of Paraná revoked the house arrest of the criminal police Jorge Guaranho indicted for the death of the municipal guard and treasurer of the PT Marcelo Arruda , in Foz do Iguaçu, Paraná. He will be sent to prison.

The crime happened during the PT’s party-themed birthday, on July 9 this year.

Guaranho, who was also injured, had been hospitalized since the incident, and his discharge was scheduled for last Wednesday (10). Initially, the court had denied the request for house arrest. However, after a letter from the Criminal Medical Complex, in Curitiba (PR), about the need for care that the criminal agent needs, the Justice replaced detention with house arrest.

This Friday (12), Judge Gustavo Germano Francisco Arguello ordered him to be sent to the Criminal Medical Complex.

“This is a request to revoke the precautionary arrest and, alternatively, to replace it with house arrest or the application of precautionary measures other than prison. This court rejected the requests made by the defense, maintained the defendant’s preventive detention, based on the guarantee of public order […]. On the same occasion, the replacement of preventive detention by house arrest was rejected in view of the lack of demonstration, by the defense, of the impossibility of the defendant receiving in the ergastule [cárcere] public the medical treatment necessary to maintain their health. As a consequence, the defendant’s relocation to the Criminal Medical Complex had been determined”, says the court decision.

The medical report on the current health status of Guaranho delivered to the Court says that he “is in a clinical condition dependent on physiotherapeutic, nutritional and neurological follow-up for his rehabilitation and dependent on third parties for basic daily activities, and
therefore incompatible with the structural conditions currently presented by this Criminal Medical Complex”.

The medical report on Guaranho’s current state of health delivered to the Court on Wednesday says that he “is in a clinical condition dependent on physiotherapeutic, nutritional and neurological follow-up for his rehabilitation and dependent on third parties for basic daily activities, and therefore incompatible with the structural conditions currently presented by this Criminal Medical Complex”.

However, according to the judge, the complex is able to receive and treat Guaranho.

“From the analysis of the new file brought to the file, it is highlighted that the Criminal Police Department of the State of Paraná, notably for its Criminal Medical Complex, ‘has conditions to guarantee the daily maintenance of the basic needs of the custodian with continuous supervision… consideration of the information from the patient’s Medical Evolution Report’, as well as attesting that there is no structural obstacle to receiving the custodian”, said the judge.

Through a note, Arruda’s defense informed that “the decision to revoke the house arrest of Guaranho meets the aspirations of society and the family victims, in the sense of doing justice.”
